Essential Invoice Requirements for US Freelancers

Ensure your freelance invoices are legally sound and tax-compliant in the United States. A checklist for 1099 contractors.

In the United States, invoicing as a freelancer (1099 independent contractor) is generally less strictly regulated than in the EU with its strict VAT rules. However, missing key information can delay your payments and create headaches during tax season.

The Required Elements

To ensure your invoice is processed quickly by US accounting departments, it must include:

1. Your Business Identity

  • Legal Name: The name registered with the IRS (your own name if you are a Sole Proprietor, or your LLC/Corp name).
  • Address: A valid mailing address.
  • Contact Info: Email and phone number.

2. Tax Identification

While not strictly required on the invoice itself (usually handled via a W-9 form), many larger clients prefer to see your EIN (Employer Identification Number) on the invoice. Security tip: Never put your Social Security Number (SSN) directly on an invoice. If you don't have an EIN, get one for free from the IRS website—it takes 5 minutes.

3. Clear Line Items & Dates

The IRS requires you to keep accurate records of your income. An invoice that just says "Services" is a red flag. Detail the exact work performed, the dates the work spanned, and the rate.

The W-9 Form

Before a US company will pay your first invoice, they will almost always ask for a W-9. This form provides them with your Tax ID so they can issue you a 1099-NEC at the end of the year if they pay you more than $600.

Pro-tip: Have a PDF of your signed W-9 ready to attach to your very first invoice email to a new client. It removes a step from their onboarding process and gets you paid faster.

Do I need to charge Sales Tax?

In the US, services (like consulting, web design, or writing) are generally exempt from sales tax in most states. However, if you are delivering physical goods, or in certain states (like Texas or Hawaii) delivering specific digital goods or software, you may need to collect sales tax.

Always consult with a local CPA regarding your specific state's nexus laws.

With tools like Invoicease, you can easily save your EIN and business address in your branding settings, ensuring every invoice you generate is perfectly compliant for US clients.
